fa تحلیل بنیادین اصل عدم مداخله در حقوق مالی دیگری عمومى General پژوهشي Research <div style="text-align: justify;"><span style="color:black;"><span style="font-family:IRLotus;"><span style="font-size:14.0pt;">انسان حق تعیین سرنوشت خویش را دارد و تنها او بر حقوق مالی خویش مسلط است</span></span></span><span style="color:black;"><span style="font-family:IRLotus;"><span style="font-size:14.0pt;">. نظم و انضباط اجتماعی نیز در جامعه ایجاب می‌کند که حقوق مالی اشخاص از ثبات نسبی برخوردار باشد و در معرض تزلزل و تشویش ناشی از مداخلۀ دیگران قرار داده نشود. به موجب</span></span></span> <span style="color:black;"><span style="font-family:IRLotus;"><span style="font-size:14.0pt;">اصل عدم مداخله، امکان دخالت در حقوق مالی بدون ارادۀ صاحب حق مالی وجود ندارد.</span></span></span><br> <span style="color:black;"><span style="font-family:IRLotus;"><span style="font-size:14.0pt;">اعتبار این اصل ازطریق پاره‌ای از اصول مبنایی نظیر اصل کرامت، برابری و آزادی انسان‌ها و حق تعیین سرنوشت قابل اثبات است.</span></span></span><span style="color:black;"><span style="font-family:IRLotus;"><span style="font-size:14.0pt;"> به موجب اصل نخست، خداوند با بخشیدن نعمت تعقل و برتری‌دادن انسان بر سایر مخلوقات، انسان را تکریم کرده است و براساس اصل دوم، انسان‌ها در ذات و خلقت با یکدیگر برابرند و هیچ موجبی برای تقدم برخی از انسان‌ها وجود ندارد؛ از منظر اصل سوم، آزادی انسان ایجاب می‌کند که آزادنه و خلّاقانه تصمیم بگیرد و تصمیم‌گیرندۀ خارجی نقشی در تحمیل اراده به </span></span></span><span style="color:black;"><span style="font-family:IRLotus;"><span style="font-size:14.0pt;">وی </span></span></span><span style="color:black;"><span style="font-family:IRLotus;"><span style="font-size:14.0pt;">نداشته باشد و در آخر تعیین سرنوشت حق هر انسانی است که با ارادۀ خویش می‌تواند آن را تعیین کند. در این مقاله نویسنده از طریق تحلیل محتوایی و توصیفی، ضمن معرفی اصل عدم مداخله در حقوق مالی دیگری، مبانی آن را تبیین کرده است.</span></span></span><span style="color:black;"><span style="font-family:IRLotus;"><span style="font-size:14.0pt;"></span></span></span></div> <div style="text-align: justify;">Man has the right to determine his own destiny and he alone is in control of his financial rights. Social order in society causes the financial rights of individuals to be relatively stable and not to be exposed to instability due to the intervention of others. According to the principle of non-interference, it is not possible to interfere in financial rights without the will of the owner of the financial right.<br> The validity of this principle through some basic principles such as; The principle of dignity, equality and freedom of human beings and the right to self-determination can be proved; According to the first principle, God has honored man by giving him the blessing of reason and giving man superiority over other creatures. According to the second principle, human beings are equal in nature and creation, and there is no reason for some human beings to take precedence. From the perspective of the third principle, human freedom requires that one decide freely and creatively and that the external decision-maker has no role in imposing his will on him and in the end, determining the destiny is the right of every human being who can determine it by his own will.
