fa ابعاد ورود اندیشۀ اجتماعی به شریعت و فقه عمومى General پژوهشي Research <div style="text-align: justify;"><span style="color:black;"><span style="font-family:IRLotus;"><span style="font-size:14.0pt;">هدف جستار حاضر نشان‌دادن ابعاد حضور &laquo;اندیشۀ اجتماعی&raquo; در شریعت و احکام اسلام با تأکید بر مجاهدت بیش از هزارسالۀ فقها و اصولیان مسلمان است. با استفاده از روش‌‌های متعددی مانند تحلیل محتوا، اسنادی و توصیفی‌ـ‌تحلیلی تلاش شد تا اشراب اندیشۀ اجتماعی در دین و شریعت اسلام و نیز فتاوی فقهی اصولی ارائه شود. ضرورت توجه به انسان و اجتماع نه‌تنها در اسلام بلکه در همۀ شریعت‌‌های گذشته نیز به‌‌گونه‌‌ای وجود داشت؛ اما این ویژگی در اسلام به‌نحو ممتازی مورد توجه قرار گرفت. </span></span></span><span style="color:black;"><span style="font-family:IRLotus;"><span style="font-size:14.0pt;">فقها و اصولیان مسلمان با مجاهدتِ حدوداً چهارده‌‌قرنۀ خود توانستند بسیاری از پیام‌‌های موجود در آیات و روایات اسلامی را دریافت کنند و با تأکید بر اموری مانند پذیرش عقل در حریم دین، قواعد حاکمۀ فقهی، تقدیم اولویت‌‌های اجتماعی، تعلیل‌‌های اجتماعی احکام و درنهایت، احکام حکومتی، در راستای صدور فتاو</span></span></span><span style="color:black;"><span style="font-family:IRLotus;"><span style="font-size:14.0pt;">ا</span></span></span><span style="color:black;"><span style="font-family:IRLotus;"><span style="font-size:14.0pt;">ی به‌‌روز از آن‌ها استفاده کنند.</span></span></span></div> <div style="text-align: justify;">The target of this essay indicate the aspects of the presence of the social thought in Islamic shariat, with emphasis on the industry of the moslem jurisconsults in this background. With using some research methods, like qualitative research, we show, first, that social thought rise from Qoran and sonat. we indicate, second, that this idea transmissions to other sections. The moslem jurisconsults and lawyers adoption this opinion from Qoran and sonat, using it in the deferent chapters of islamic feghh science.
