fa روش‌شناسی حل مسائل اخلاق زیستی در نظام فقهی ـ حقوقی اسلام Bioethics Methodology in the Islamic Legal System عمومى General پژوهشي Research <div style="text-align: justify;">چکیده<br> روش‌شناسی اخلاق زیستی اسلامی عهده‌دارِ تبیین منطق و چارچوبِِ استخراج قواعد رفتاری حوزه زیستی است. این منطق و چارچوب که متناسب با اراده‌گرایی حکیمانه است، در موارد ذیل به کار می‌آید: شناخت مسئله، موضوع و رجوع به منابع و ادلۀ معتبر. در این نوشتار، روش‌شناسی اخلاق زیستی اسلامی، در سه بخش سامان‌دهی شده است؛ «روش شناسایی حل مسئله»، «موضوع‌شناسی» و «حکم‌شناسی». در بخش مسئله‌شناسی مشخص خواهد شد «شناخت مسئله» با توجه به شرایط محیطی به ویژه مبانی فکریِ محیط شکل‌گیری، با «حل مسئله» متفاوت است. محقق هنگام مواجهه با هر مسئله باید مشخص سازد از اساس مسئله‌ای وجود دارد یا وجود مسئله، توهم شده یا مختص محیط دیگری بوده است؛ بر فرض وجود، سنخ آن چیست؛ تا در مراحل بعد بتوان روشن ساخت با توجه به سنخ مسئله، روش‌شناسیِ پاسخ به آن چیست. در بخش حکم‌شناسی نیز، سنخ قواعد مورد نیاز در این حوزه بر اساس سنخِ مسائلِ آن تبیین شده است؛ از جمله: مصالح معتبر، سیاست‌ها و قواعد کلی.<br>  </div> <div style="text-align: justify;"> <br> <strong>Abstract</strong><br> The methodology of Islamic bioethics explains the logic and framework to understand the problem, subject and referring from the sources and valid evidence with the aim of extracting bio-field behavior rules in accordance with the rational command theory. The methodology of Islamic bioethics is organized here based on three part of problem-solving, understanding the subject matter and inferring the rule. In the part of understanding the problem I will explain that recognizing the problem has different aspects. Due to environmental conditions, especially to the theoretical environment around the formation and problem solving context when faced with any problem, the researcher should determine that is there any real problem or there is an illusion or the problem is specific to another environment. And also on the assumption that the problem exists what sort of problem it is and based on the answer what is the methodology for solving the problem.
