fa کاربست‌های مشروع زبان در تفسیر قانون مدرن عمومى General پژوهشي Research <div style="text-align: justify;"><span style="font-size:11pt"><span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><span style="font-family:Calibri,&quot;sans-serif&quot;"><span lang="FA" style="font-size:14.0pt"><span style="line-height:115%"><span style="font-family:IRLotus">توجه به تأثیرات زبان در قانون ذیل مراحل تقنین، اجرا و تفسیر یک متن قضایی می‌تواند یکی از عوامل رشد هر نظام حقوقی تلقی شود؛ امر مهمی که در نظام حقوقی ما به غفلت و اجمال برگزار شده است. این تحقیق با استفاده از روش توصیفی و کتابخانه‌ای به کشف کاربردهای زبان در قانون پرداخته است. فرضیه اثبات‌شده نشان می‌دهد رابطۀ معناداری میان زبان‌شناسی قانون مدرن در توجه به متن، قصد و زمینۀ اجتماعی فهم قانون وجود دارد که می‌تواند به‌صورت استدلال‌ورزی غایت‌نگر به قراین منضبط، ارزش‌های اخلاقی نظام‌مند، پیامدگرایی و ابهام مشروع در تفسیر دست‌مایۀ قوانین آیین دادرسی یا قوانین آیین‌نامۀ داخلی پارلمان صورت بگیرد تا ارتقای حاکمیت عینی و عملی قانون را محقق کند.</span></span></span></span></span></span></span></span></div> <div style="text-align: justify;"><span style="font-size:11pt"><span style="line-height:normal"><span style="font-family:Calibri,&quot;sans-serif&quot;"><b>&nbsp; </b><span style="font-size:14.0pt"><span style="font-family:IRLotus">Paying attention to the effects of language in the law in the stages of enactment, implementation and interpretation of a judicial text can be considered as one of the growth factors of any legal system; An important matter that has been neglected in our legal system. This research has explored the uses of language in law using descriptive and library methods. The proven hypothesis shows that there is a meaningful relationship between the linguistics of modern law in regard to the text, intention and social context of the understanding of the law, which can be used as an end-oriented reasoning towards disciplined evidence, systematic moral values, consequentialism and legitimate ambiguity in the interpretation of the rules of procedure or internal regulations.
